One of the things that Georgia law has that many people are surprised to learn is a provision that if you are driving a car and you have any child in the car under the age of fourteen, that can constitute a whole separate DUI in addition to what you're charged with for your DUI, per child in the vehicle. If you have three children in the car under the age of fourteen and you get stopped for DUI. You are going to face four DUI charges in one prosecution. If you lose that, you can find another way to work or to get around because you won’t be driving for a long time.

When we have these situations, it sometimes reduces our ability to find a good solution for you that doesn't include at least one DUI. We do try to keep the person driving because that can be devastating to not be able to drive for five years. Don't risk it because each one of those also carries a ten day minimum sentence for having a child in the car because it’s actually an endangerment of the child’s situation that’s punished pretty severely. If you have children in the car you're risking many DUI’s and the punishment can be very severe. In some states such as Illinois the minimum jail is six months on one time, one child, and first offense. Don't ever risk it anywhere because the laws are tough all over the country.
