Sometimes people want to know, “Well what are my chances if take it to trial?” We can’t tell you that at the early part of the case because we don't know what evidence is going to be left in the case by the time the motion hearings are concluded. For example if we keep your breath test out you can go from a thirty percent chance of winning to a sixty or seventy percent chance based on averages of cases similar to that that we've taken to trial before.

We don't know that till near the end of the case. We’ll try to tell you that. Simply by knowing that every time a hundred of these cases are tried we’re going to win seventy percent or seventy five percent is our estimate. That’s nothing but an estimate. Every case is made or lost on its own facts and its own witnesses. What we try to do is know the case backward forward and cold every direction, we need to know it because surprises are the last thing we need. We’re they're trying to make sure we know the facts and we can put it in front of a injury in a manner that they see that there's reasonable doubt and a good reason to say not guilty.
