One of the largest points of confusion, I guess, that happens more than half the time, is that if a police officer officers someone a hand held tester on the side of the road (one of these devices that has the breath piece on it) they think that is the breath test. That's not the breath test. That’s not an evidential test at all because it doesn't print out a result these. These are optional and voluntary. You should never take one of these. When you get to the police station and there's a machine plugged into the wall into a hundred and fifteen volt outlet or it might be in a BAT mobile (mobile breath alcohol test unit) that's the official test.

In some cases, such as an accident, they're probably going to take a blood test because you're not going to be able to take a blood test at the jail. If that test is asked of you that's the official test. That’s the one that your driver's license depends on you taking. Don't get confused with a handheld tester, that's optional. The one at the station or the blood test at a hospital is not optional. That's the official chemical test required by law to keep your license. If you refuse you may have twelve months of not driving at all.
