If you're arrested for DUI in Georgia you should look through the paperwork you received and see if you have an 8x11 yellow form called a 1205 form. It will be on the lower left hand corner of the front of the form. This is a document the officer fills out if you refused the test, or if you took the test and were over the legal limit. If you're under 21 that's .02, if you're a commercial truck driver who was in a commercial vehicle .04, and anyone else 21 and over is .08.

If you took the test and were per se, that is over the legal limit, or you refused you should have this form. Even if you didn't get it you need to call us and let us send a protective letter to the Department of Driver Services to make sure you get a hearing. If the form was filled out but you didn’t get your copy, don't take a chance. We do this as part of our fee if you hire us. There's no reason not to do it.
