Once the case has gone past arraignment. There is a process called criminal discovery. That allows each side: the defense to ask the state and the state to ask the defense for information about the case. This can include things such as a list of witnesses. We are able to get videotapes that the police took of your arrest that night if any exist. We are also able to see what information that the state plans to use against you such statements that you may have made that night that even may not be on videotape.

This discovery process can last anywhere from 30 days to several months. And it is a back and forth process that doesn’t stop at the first part of the case but continues later on. We engage in this discovery process because we want to know everything that the police have against you so we can evaluate your chances of winning if you do go to trial.
