Georgia DUI Intoxilyzer 5000 Source Code Litigation
Presently in the United States there's some litigation going on challenging this machine called “source code litigation”. We have been asking for the last two years and more than three dozen cases that the state be required to turn over the source code. If not the state, we have asked courts to let us subpoena the source code from the manufacturer in Owensboro, Kentucky. To this day not one single state, not one single court, not one single agency outside the company has ever seen the source code.
Now think of twenty five plus years this machine has been used and over twenty five million breath tests performed and no one has ever tested the machine to see if the source code will actually do what it says. We know it won’t shield against RFI, you’ve already seen that. We know that moisture can get into it despite the very sophisticated breath test mouthpiece that I showed you. If you feel comfortable having your breath tested and being convicted and sent to jail sometimes (off of these readings) then you don't need to come see us. Our job is to fight false evidence and if we think this machine gave a false reading, we'll tell you why and how and we'll show you how we're going to attack it.
