A person who has a prior DUI conviction and is arrested again needs to know about a special federal law called the Interstate Compact. If you go to the web site interstatecompact.org , look that up and look at 2.105, that's the rule that starts talking about the fact that you can't leave the state that your sentenced in if you have a sentence of twelve months or longer and you are on probation. That means if you were from Tennessee and came to Georgia and plead guilty to a DUI that had twelve months for the DUI probation and twelve months for a lane violation stacked on top of that making twenty four months.

If you had a prior offense you couldn’t even go back to Tennessee that day. You would have to stay in the state of Georgia until you've got permission to go to your home state. This law is very serious and many people don't know the impact and sometimes unfortunately their attorneys don't even tell them about this. The interstate compact is applicable to every state. Don't go into a plea and fail to fight your case and then discover that you can’t travel or leave the state that you are sentenced in without permission from the incoming State.
