Georgia law does have several other serious driving offenses that are treated as harshly and sometimes more harshly than a DUI. For example attempting to elude an officer is a misdemeanor in every situation that the state can prove it but it can actually be a felony. In a simple first offense attempting to elude an officer the minimum jail sentence is ten days in jail. The judge can’t reduce it to less than ten days.

With the DUI the judge can reduce it to no jail at all if there's a reading under a .08 or if there’s a refusal the judge has the option of giving no jail time. If you have a .08 or more than minimum is twenty four hours in jail. Attempting to elude an officer can carry severe penalties including license suspension because it is a serious driving offense.
