In Georgia, vehicular feticide is actually divided into two degrees. Each has its own law and therefore its own punishments. Here, we’ll explain the differences.
First Degree Vehicular Feticide
Your case will involve first degree vehicular feticide if a quick or viable fetus dies as a result of vehicular violation, which would constitute first degree vehicular homicide under O.C.G.A. 40-6-393. A quick or viable fetus is one that is capable of remaining alive outside of the womb. If you are found guilty of first degree vehicular feticide, you will be charged with a felony. The punishment for this is two to fifteen years in prison.
Second Degree Vehicular Feticide
Second degree vehicular feticide refers to a fetus that has already adequately developed, but dies due to a driving violation, which would be considered second degree vehicular homicide under O.C.G.A. 40-6-393. If you are found guilty of second degree vehicular feticide, you will be charged with a misdemeanor. In Georgia, you can face up to 12 months in prison for such a conviction.
