If you took a breath test or even a blood test you're going to be charged with two types of DUI alcohol. One of them is for taking the test and being over the legal limit, that’s called per se, and the other is traditional or common law DUI which we call less safe DUI in Georgia.

That's for just being under the influence of alcohol to whatever extent the law says you cannot be which is you cannot be less safe to drive due to consuming alcohol. The prosecutor would charge it both ways and they'll ask the judge or the jury who hears the case to find you guilty of one or the other. Either conviction is a DUI. They come at it two different ways and that's why you need an attorney skilled in DUI law to be able to fight those cases.
