We may find that your case is in front of a judge and a prosecutor who try to use the leverage of getting you to plead guilty in order to get a better sentence. The prosecutor may say, “Well I’m going to offer you this, but if you go to trial you can expect the judge to give you the ten days that the statue requires. Believe it or not Georgia law was written to say, “On a first offense (lifetime offense) ten days to twelve months is the sentence but the judge has the discretion to reduce that to zero if there’s refusal or no test result above a .08. If it’s a .08 or above it’s a twenty four hour minimum.

You're going to be given the choice. Take the plea and plead guilty to DUI or go forward for trial and see if you can win. The one thing I'll tell you is that that ten days will seem like nothing compared to the rest of your life having to deal with and explain away a DUI. Just the insurance hit alone will make you think about it every time you send in a premium.
