Some people come to us and say, “I got charged with DUI and I had another one but it was a long time ago so it shouldn’t have any effect on this case.” Even though the law has minimum mandatory punishment for offenses now that occurred within the last ten years, under the new law that went into effect July 1st, 2008, a judge can look at your entire history. This includes arrests for DUI that were reduced to other charges and he or she can sentence you according to your entire record.

Therefore don't walk into court thinking, “I’m going to be treated as a first offender because something happened fifteen or twenty years ago”. Some judges look at the entire history and will punish you more if you have a prior history. We will know those tendencies. We will know the court. We will be able to tell you what to expect. We may be able to tell you why you don't want a second DUI on your record for more reasons than just punishment.
