A famous comedian said, “I had the right to remain silent but I didn't have the ability to remain silent.” Unfortunately in this country that seems to be the constitutional right that most Americans either don't understand or they think, “I'm going to abandon this right and see if I can talk my way out of this”. That's not going to happen in 2008 and after. This is going to be an arrest and they are going to use what you say against you. “But I only had three drinks” or “I had my last drink four hours ago”.

Those things will come back to haunt you later. Exercise the right to remain silent and don't admit consuming alcohol. Don't admit to using anything that would impair you. Those questions you don't have to answer unless you have an attorney present. They’re not going to let you have an attorney present and will not to let you call an attorney but you must remain silent, it's the best choice.
