There's a legal process called the discovery process that pertains to getting evidence that the prosecution has against your client. We use this in a formal manner by filing documents that forces the state to turn over what we need for the trial. There's something else to goes on if you do these all the time. That is that you may use an informal process and use open records or subpoenaed procedures to go get records that are going to disappear if you don't get them quickly. For example Sandy Springs police is using the Doraville police department to house prisoners right now.

Doraville police department has cameras inside the jail in several positions including the breath test room. If we need those and we do in every case we go get them early before those are recycled and there's footage put over the top of the previous film because they're only there for their own internal security reasons. They are not there for preservation. We go get those and put them in our file and this has been the winning ticket on many cases when we know there's an internal video and we have it. The state didn't even bother to get it themselves.
