This is the book I wrote for clients called The DUI Book. It's a citizen's guide to how we fight cases so that you know what we're going to do to try to help you win. Now I’ve opened the book up because starting on page 358 is a checklist for detection of scientific error in blood testing. I want to talk to you about blood tests. Many people who come in say, “Mr. Head I don’t think there’s much chance. I've got a blood test. I can’t win. There again you shouldn't be trying to be the attorney unless you are one. Blood tests are easier for me to beat than a breath test in many situations.

Why is that? I’ll give you three good reasons. First, blood tests are rare. The police officers don't know how to deal with them. There are certain procedures they’re supposed to follow and there are several people involved in that chain of command that can always create reasonable doubt in cases. Many times these blood tests are not transported immediately and they can deteriorate and when blood breaks down through decomposition one of the byproducts of that the decomposition is alcohol. It makes alcohol. It can add to your reading. The other thing is that getting all those people to court so that they can verify the blood results sometimes just doesn't happen. Or the GBI won’t turn over all the paperwork that’s needed that we've requested in discovery, and we can have the judge say, “Blood test is out”. If a blood test is in the case, don't give up.
