If you are asked by a police officer to blow into a hand held detector at the roadside, let me tell you what that involves. Many of them will tell you, “this test is not the official test, so blow into this and I'll determine whether there's any alcohol in your system or not”. They try and tell you that, “it’s not an official test and it won’t be used against you”. Well that's bull. It will come into court and they'll be able to say you blew positive for alcohol on this device, but they can’t use the number.

Afterwards if you don't take the test at the station, which is the one that can suspend your license for not taking, they'll say, “well once he or she blew in this handheld device and saw their alcohol level, they refused to take the test at the station because they knew that it would show they're under the influence”. Don't get caught in that trap as this is a voluntary test. The one at the station is required for you to keep driving. Know your legal rights and you can do a better job protecting your constitutional right out at the roadway.
