Non-moving violations usually occur when the vehicle is parked or from faulty equipment. Examples include: broken muffler, bad headlight, or illegal parking.

Is it a misdemeanor or an infraction?

To prevent our country’s judicial system from “clogging up”, many basic traffic citations are labeled as infractions. This expedites the process and avoids the necessity of a lawyer or jury. When the stakes are higher than a basic fine, the charge is increased to a misdemeanor or felony, allowing the defendant full access to the legal system. Misdemeanor traffic violations may include hit and runs, or accidents involving injuries.
