One of the things that can happen under Georgia DUI law and the law of most other states is that after a certain number of repeat offenses the penalties will be enhanced. For example, on a third or subsequent offense (third, fourth, fifth) in ten years in Georgia, you can be punished much more harshly because any jail time you get is called high and aggravated time. It’s called a high and aggravated misdemeanor. These offenses carry twenty six days out of every thirty days that you are sentenced that you cannot get out of jail. In other words no good time credit.

The judge gives you a sentence of one full year because you're a fourth offender and its high and aggravated misdemeanor punishment. You're going to serve ten months and fourteen days before you can get out of jail. Don't risk your freedom and give us a call and we will look for alternatives which we can help you with. If you're prepared to go to trial you might still be able to go to trial and try to avoid the conviction altogether. If you're not prepared then be ready to spend a good bit of time in one of Georgia's jails, because the judge will sentence you to jail if you lose.
